What Exactly is the Fair Work Agency?
Think of the Fair Work Agency as a "one-stop-shop" for workplace rights enforcement. Before this, enforcement was a bit messy. You had HMRC looking after the National Minimum Wage (NMW), the Gangmasters and Labour Abuse Authority (GLAA) handling specific sectors, and the Employment Agency Standards Inspectorate (EASI) looking at recruitment agencies.
The FWA has brought these bodies under one roof. Established under the Employment Rights Act 2025, its mission is simple: to ensure every worker in Great Britain gets what they are legally entitled to.
But it’s not just an administrative merger. The FWA has been given some serious "teeth." For the first time, there is a central body with the power to investigate and penalise businesses for things that used to only be settled in a private Employment Tribunal: like holiday pay and Statutory Sick Pay (SSP) errors.
The "Triple Threat": NMW, Holiday Pay, and SSP
The Fair Work Agency is focusing its lens on three main areas. If your payroll isn't "bulletproof" in these categories, you could find yourself on the wrong side of an investigation.
1. National Minimum Wage (NMW)
While HMRC is still handling the day-to-day enforcement of NMW under a contract with the FWA until April 2027, the strategy is now driven by the Agency. The rules around what counts as "working time" and what deductions you can make are tighter than ever. Whether it’s uniform costs or travel time, the FWA is looking for any slip-up that dips an employee's pay below the legal floor.
2. Holiday Pay: A New Record-Keeping Duty
This is a big one. As of April 2026, there is a new legal duty to keep adequate annual leave and holiday pay records for six years.
Previously, if you got holiday pay wrong, an employee had to take you to a tribunal. Now, the FWA can walk through your door, demand to see six years of records, and issue fines if they find you haven't been calculating pay correctly (especially for those with irregular hours).
3. Statutory Sick Pay (SSP): Day One Rights
The rules for SSP changed significantly on the 6th of April 2026:
- Payable from Day One: The old "three waiting days" rule is gone.
- Lower Earnings Limit (LEL) Removed: Every employee now qualifies for SSP, regardless of how little they earn.
- The 80% Rule: For lower earners, SSP is now capped at 80% of their average weekly earnings (if that’s lower than the standard rate).

The Sting in the Tail: Penalties and Public Naming
We’ve always told our clients that compliance is cheaper than the alternative, but the FWA has made that even more true.
If the Agency finds an underpayment, the standard civil penalty is now 200% of the underpayment, capped at a whopping £20,000 per worker. While this can be reduced to 100% if you pay up within 14 days, it’s still a hit that most small businesses simply can’t afford.
Beyond the financial cost, there’s the "Naming and Shaming" list. The government regularly publishes the names of businesses that have failed to pay their staff correctly. In an age where reputation is everything, being on that list can make it impossible to hire good people or win new contracts.
